ASIAN HUMAN RIGHTS COMMISSION-URGENT APPEAL PROGRAMME
Mr. Aadawalage Gayan Indika (26) of No 6th Canal, Kagama in Kakirawa in the district of Anuradhapura is married and father of one son. Gayan was travelling with his brother on his motorbike when they were stopped by plain clothed persons who demanded their identities. When Gayan in turn demanded the identities of the group he was told that they were officers of the Kakiwara Police station. Gayan was accused of making illicit liquor and when he refused the accusation he was severely beaten by the officers who he believes were working hand in hand with the person actually producing the liquor. This is yet another example of the breakdown of the Sri Lankan policing system.

Mr. Pattini Razeek, a well known human rights activist and a member of the executive committee of Forum Asia disappeared on February 11, 2010, yesterday (July 28) his body was exhumed before the Valachchenai Magistrate. The body had been buried within a half built private house in a remote village in Uddamaveli, Valachchanair and the location was identified due to a lead given by a suspect. The body has been sent to the government analyst department for scientific identification on the orders of the Magistrate. For the last one and a half years there had been a continuous demand from the members of his family, from the people in his residential area as well as from human rights organisations in Sri Lanka and abroad for an investigation into his disappearance. Razeek was the head of the Community Trust Fund (CTF), a Sri Lankan NGO based in the town of Puttalam.

Today, the 9th September, Sri Lankans woke up to a country which has changed politically in its character and in its legal system. With the passing of the 18th Amendment Sri Lanka has abandoned liberal democracy completely and all the debates that the country has had so far will now change in a most significant manner.

It is an alarming eye opener but yet just another incident experienced by many Sri Lankans in their day to day life that shows the reality of the practice of policing in Sri Lanka. While three members of parliament (MPs) and a Provincial Council member went to make a complaint at the Headquarters Police Station of Galle two of the MPs were assaulted and put into a cell. The police then filed fabricated cases against them. Sadly there is nothing unusual about this. However, it does show the inability of the Sri Lankan police and their unwillingness to implement the rule of law in the country.

For several decades now the Sri Lankan people have been exposed to extraordinary acts of separation, large scale forced disappearances, extrajudicial killings, torture, illegal arrest and detention. This and large scale displacement of people from their homes by way of internal displacement or by leaving the country altogether and the disappearance of even elementary forms of protection available to people within the legal and social sphere are among the many issues that have caused massive forms of trauma in the population as a whole.
